BUG: re-ordering albums and title

this one is pretty difficult to describe.. so listen carefully and try to duplicate.

sczenario:
empty album

create category "whatever"
create album1 and fill with pictures
create album2 and fill with pictures
create album3 and move it to top of list (using admin module)
enter pic "pic.jpg" and describe as (title)"pic"
enter pic "pic_1.jpg" and describe as (title)"pic"
enter pic "pic_2.jpg" and describe as (title)"pic"

now, what happens? pic_1 and pic_2 are not listed. they show up in the block, and they are in the sql table. but admin module does not list them. neither they are shown if you choose from modules, and list the albums.

now the hammer. if i delete the complete album named "album3", the pics are still in tze sql table(!!)

i am unsure yet, why this happens. it could be infact of moveing an empty album to the top, but my 2cents bet is:  i added pics with the same title.
