Next time you have issues with uploading, post your issues on the corresponding board. Moved your thread accordingly.
It's mandatory to read the documentation before asking questions (you agreed to do so when signing up). You should do so now, especially the upload troubleshooting section of the docs. Do exactly as suggested there if you need help. Make sure to test with a known-good jpeg file.

be nice if evertime I upgraded, It would not mess up my gallery, ever time I upgrade, I lose my config button...Explain that

What is the point of your reply? You have done nothing about your upload issue and instead are whining about something completely different.

Additionally, your issue would have been solved if you did as suggested and read the docs - they explain why the config button is missing when upgrading your coppermine install and failing to upgrade your custom theme as well. However, that's another issue that should go into another thread (you should read the docs before asking though, to avoid making a fool out of yourself once more). What's the point in shouting at supporters? Review your attitude! You're using free software, remember. This doesn't make the software bad, but should give you the correct perspective: we don't have a company<->customer relation, as you don't pay us. We are peers, neither do you owe us money nor do we owe you anything. However, you're inside our living room, so don't shout at us - you're our guest. This means you owe us respect. Fail to show us this respect and you'll be ignored or even banned.
