When users upload files they immediately appear the the designated gallery, changing the group upload permission both for public or private makes no difference.

The upload approval button also is not present. (maybe because there is no uploads to approve)

I am using a custom theme based largely on Hardwired and the  galleries are bridged to vbulletin  forum.

Why does the require approval not appear to work and where or when should the upload approval button appear?

Appears on the left on the admin menu when there is something to approve. Make sure you actually enabled upload approval on the groups page.

Thanks Nibbler sorry about that.

Upload approval on the groups page is set to yes for both public and private galleries, however as posted the uploads go straight into galleries without requiring approval, hence possibly why the approval upload button doesnt show.

Can you post a screenshot of your groups page, link to your gallery, test user account and debug mode enabled if poss.

Why not? And what's wrong with a link? You can't expect support if you don't allow us to take a look ourselves. Make sure you check approval while not being logged as admin, but as a regular user. For the admin, even the pics that need approval will show in the albums they're suppossed to reside in later.
