Is it possible to hide the upload link if the person cannot upload? It's probably possible but would it impact performance too much?
upload button hidden when not allowed to upload should go into cpg1.5, not possible that easily for the current stable imo

ok but what about the registered members? The upload doesnt work for anyone in user mode.
The members must be in admin mode.
I recommend disabling the user mode link altogether, will stop the confusion both for you and your users.
well here is the thing....I leave for basic training on Wed. I was wanting it so that my members could upload pics as they wanted while Im gone but I do not want to give them admin access. I take it Im not getting any help here for my error, just a sloppy work around?

disabling the "user mode link" is not a workaround. User mode is meant for the admin to see the gallery with the "eyes" of a regular user (i.e. without the admin menu and additional albums controls). It's most helpfull when creating a new theme, nothing else. You don't lose any functionality when you disable it. Your users will not be admins if you disable the "user mode" link. In the next version, the user mode link will be removed permanently for regular users, as it doesn't make sense for them.
@kego: I'm not sure what you actually want to look into, this is just a problem of 26cmg77 not fully understanding the concept that's behind coppermine, there's no actual malfunction as far as I can see.
