The theme it's called 'layout04'. He/she is using a customizated fiblack3d (http://coppermine-gallery.net/demo/cpg14x/index.php?theme=fiblack3d) theme.
He is also violating some GNU/GPL rules. He's hiding the credit link using the same color as background.
