I'm still using 1.2.1 because I heavily modded it and it worked fine until we moved to another server.

That is a 1.3 problem, and you say you are running 1.2.1.
Are you trying to use some 1.3 files (such as searchnew.php) with 1.2.1?
Have you chmoded these folders to the same as the albums folder?
I just uploaded a standard 1.2.1
all my folders are chmoded 777
I'm such a dumb ::)
My base directory wasn't set...
