You wouldn't be trying to batch add from under the userpics directory would you by any chance ?

What does that mean? all my image folder are located /gallery/albums/userpics/myfolder and it works fine for old version.
when i upload 1.3 to my server i didn't replace userpics folder just add index.html and leave that folder alone...so could it be that problem.

Read the documentation:

QuoteIt's recommended that the coppermine admin uses ftp to upload many pics in one go. Use your ftp software to create sub-folders within your_coppermine_directory/albums/, where your ftp uploads can go to. It's a good idea to have a folder structure within the albums folder that reflects your coppermine categories and albums, but it's not mandatory.
Important: do not create folders or upload to the userpics- nor the edit-folder by ftp: these folders are used by coppermine internally and mustn't be used for any other purpose!

you were never meant to ftp-upload to userpics, in no version of coppermine. This has always been in the documentation that came with the coppermine package, but nobody cared to read it. Since ftp-uploading to userpics can cause strange errors (while it may work for others), we decided to just not show the userpics folder in the batch-add routine to force users to upload to the proper folder structure. For details search the board, there have been lengthy discussions about this issue.
