I just ran the upgrade from 1.4.9 to 1.4.12 and then the versioncheck. It came up with 2 outdated files and 5 missing files.

One of the oudated files is anycontent.php which in the upgrade instructions I am told I am to not overwrite, the other one is install.php which I guess I do not need anyway.

Missing files are

albums/index.php
albums/edit/no_FTP-uploads_into_this_folder!
albums/userpics/index.php
albums/userpics/no_FTP-uploads_into_this_folder!
include/archive.php

I'm not sure how to fix these.

You should make sure to copy the missing files from the cpg1.4.12 package to your webserver (using your FTP app). If they exist and versioncheck just can't find the, you can savely ignore the message.
The only file that really is mandatory is include/archive.php - the other files are just nice-to-have, but not mandatory.

albums/index.php - there was an index.html, is that still needed?
albums/userpics/index.php - there was an index.html, is that still needed?

No , Thats Okay... index.html works just like index.php in this case
